Non compliant panel members will be required to motivate why they

should be allowed to remain on the panel.

11H45 12H45 5. DEBATE: Consider the following scenario: You are the adjudicator on an NEC 3 ECC

option A Contract. You are aware that there are multiple disputes arising out of this

contract which have been referred to other ad hoc adjudicators. Having received the

submissions from the Parties, it is apparent to you that the Parties and the Project Manager

are not conducting themselves in a spirit of mutual trust and cooperation and that this is

leading to the multi dispute situation prevailing on the contract.

The programme is regularly submitted in accordance with the requirements of the contract

by the Contractor but it has not been accepted for a very long time by the Project Manager.

The Contractor complains that the information necessary to compile the programme,

concerning the Employers obligations has never been provided. The Project Manager

complains that the programme does not comply with the requirements of the Works

Information.

You realize that the atmosphere on the project is toxic and that disputes will continue to

manifest.

The project is of strategic national importance.

What action can you or should you take to address the apparent ills of the project?
